1. Acceptance of Terms
By accessing or using the Caretable platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including referral agencies ("Referrers") and service providers ("Providers").
2. Description of Service
Caretable is a referral exchange platform that enables social service providers and referring institutions to exchange client referrals in real time. The platform facilitates the connection between agencies seeking services for their clients and providers who offer Home and Community-Based Services (HCBS) and related social services.
3. User Accounts and Registration
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must immediately notify Caretable of any unauthorized use of your account.
- You may not share your account credentials with any third party.
- Caretable reserves the right to suspend or terminate accounts that violate these Terms.
4. HIPAA Compliance and Protected Health Information
Important Notice Regarding PHI
Caretable processes Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). All users must comply with HIPAA regulations when using this platform.
- Business Associate Agreement (BAA): Organizations using Caretable to transmit PHI must execute a Business Associate Agreement with Caretable prior to use.
- Minimum Necessary Standard: Users must limit PHI shared through the platform to the minimum necessary to accomplish the intended purpose of the referral.
- Access Controls: Users must not share login credentials and must log out after each session. The platform enforces a 15-minute inactivity timeout.
- Audit Logging: All access to PHI is logged for compliance and security purposes. These logs are retained for a minimum of six (6) years.
- Breach Notification: Users must report any suspected breach of PHI to Caretable within 24 hours of discovery at info@caretable.com.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Submit false, misleading, or fraudulent referral information.
- Attempt to access data belonging to other users without authorization.
- Use automated tools or scripts to access the Service without prior written consent.
- Interfere with or disrupt the Service's infrastructure or security.
- Share or disclose PHI outside of the platform without proper authorization.
6. Referral Responsibilities
- Referrers: Must have proper authorization to refer clients and must ensure client consent has been obtained before creating referral posts.
- Providers: Must accurately represent their services, licensure, and availability. Accepting a referral creates an obligation to follow up in a timely manner.
- Both parties are responsible for maintaining appropriate documentation outside the platform as required by applicable regulations.
7. Trial Period and Fees
Caretable offers a free 3-month trial period. After the trial period, continued use of the Service may require a paid subscription. Caretable reserves the right to modify pricing with 30 days' written notice. No credit card is required for the trial period.
8. Limitation of Liability
Caretable is a platform that facilitates referral coordination. Caretable does not provide social services, medical care, or clinical recommendations. Caretable is not liable for the quality, availability, or outcomes of services provided by Providers listed on the platform. To the maximum extent permitted by law, Caretable's liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. Upon termination, Caretable will retain PHI and audit logs as required by HIPAA regulations (minimum six years). You may request deletion of non-PHI data by contacting info@caretable.com.
